Can parents prevent their children from getting married?

I and my girlfriend, Minh Anh, are 26 years old this year. We have known each other for 2 years. We have not been married yet but now she is pregnant. We planned to get married and get married on September 30th, 2020 but her family didn't want us to get married because I didn't have a stable job and they told me if we still do get married, our wedding will be obstructed. FDVN’s Opinions:

Thank you very much for submitting questions to FDVN Law Firm (FDVN). After studying relevant legal regulations, FDVN has some opinions for your consulting request as follows:

According to Article 5, Law on Marriage and Family 2014, marriage and family relations established and implemented in accordance with this Law shall be respected and protected by law.

Moreover, Clause 2 Article 5 of this law has a provision about prohibited acts as follows:

“a/ Sham marriage or sham divorce;

b/ Underage marriage, forcing a person into marriage, deceiving a person into marriage, obstructing marriage;

c/ A married person getting married to or cohabitating as husband and wife with another person, or an unmarried person getting married to or cohabitating as husband and wife with a married person;

....”

Accordingly, obstructing marriage is one of the prohibited acts of the Law on Marriage and Family 2014 to protect the marriage and family regime. Thus, the acts of your girlfriend's parents is a violation act. All acts of violating the Law on Marriage and family must be handled strictly under the law.

Under the provisions of Article 55 of Decree 167/2013/ND-CP regulating the sanctioning of administrative violations in social security, order and safety; prevention and fighting of social evils, fire and domestic, the acts of preventing others from getting married or preventing voluntary marriages may be subject to a warning or a fine of between 100,000 and 300,000 VND.

Besides,  according to Article 59 Decree 82/2020/ND-CP stipulating the sanctioning of administrative violations in judicial assistance; judicial administration; marriage and family; civil enforcement; enterprise and cooperative bankruptcy takes effect from September 1st, 2020, the acts of preventing marriage can be administratively sanctioned with a fine of up to 5,000,000 VND.
