CASE LAW NO. 59/2023/AL ON THE INDIRECT AND DELIBERATE FAULT IN A CASE OF MURDER

Case law situation: The defendant used a dangerous weapon to attack the victim. The victim drove a motorbike trying to escape, the defendant continued to chase which terrified the victim, caused him to speed up and run away. The defendant stopped the pursuit only when the victim got in an accident. The victim died on the way to the hospital. 

Legal solution: In this case, the defendant must incur criminal liability for "Murder" as indirect and deliberate fault.
