CASE LAW NO.39/2020/AL REGARDING THE DETERMINATION OF CIVIL TRANSACTIONS DUE TO INVALID CONDITIONS

Case law situation:

Tenant of the state-owned house (the seller) commits after purchasing transfer price of the state-owned house, the ownership of the house will be transferred to the buyer. The seller received the money and handed over the house to the buyer, but the State fail to transfer the price and recognize ownership of the house.

Legal solution:

In this case, the contract of transfer house ownership must be determined as a conditional civil transaction but null and void due to failing to make the conditions of the contract.
