CASE LAW NO.41/2021/AL ON THE TERMINATION OF THE ACTUAL MARRIAGE

Case law situation:

Men and women cohabitate as husband and wife, do not register their marriage but then they no longer live together and before the 1986 Marriage and Family Law came into effect, someone cohabitated as husband and wife with other people. The first and second marriages are both actual marriages.

Legal solution:

In this case, it must be determined that the first actual marriage was terminated.
