I am a civil servant. I now have a need to learn the law on the appraisal of prices. So, I would like to ask you about the conditions for becoming a price appraiser? Can I becoming a price appraiser in case I am a civil servant? Can I work for a company of price appraiser?

[1]. Criterion of price appraiser

Pursuant to Article 34 of the Law on Prices 2012, specifying criteria for price appraisers are as follows:

“1. Possessing civil act capacity.

2. Possessing ethics quality, integrity, honesty, objective.

3. Graduating university in specialty related to price-appraising operations.

4. Having worked with the trained specialty for 36 months or more since possessing a university degree in specialty line specified in clause 3 of this Article.

5. Possessing the certificate of professional training in price-appraising operations, granted by competent agencies.

6. Possessing card of price appraiser as prescribed by the Ministry of Finance.”

Practicing price appraiser is a person having full criterion specified in Article 34 of this Law and registering for practicing price appraisal in a price-appraising enterprise.

However, according to Clause 2, Article 36 of the Law on Price 2012, the provisions on persons not entitled to practice in price-appraising enterprises: “2. Cadres, public employees as prescribed by law on Cadres, public employees; officers, professional soldiers, defense workers in agencies, units under People’s army; officers, profession non-commissioned officers, officers, technical specialized non-commissioned officers in agencies, units under People’s Security Public."

Thus, even though you meet the conditions stipulated in Article 34, you are not allowed to practice at the appraisal enterprise for the reason that you are a cadre.
