Does Livestream infringe copyright?

Nowadays, with the high technology, we are able to film and broadcast live so that a lot of people in different places can watch together, which is called “Livestream”. So, many people come to the cinema, film the movie and broadcast live on Facebook. I would like to know if this act infringes on the copyright of the movie and the penalty for this act.

[1] According to point e Clause 1 Article 14 of the Law on Intellectual Property 2005, amended and supplemented in 2009, “cinematographic works and works created by a process analogous to cinematography (hereinafter all referred to as cinematographic works)” are protected by copyright.

It is stipulated in Clause 3, Article 28 of this law that “Publishing or distributing a work without permission from the author” is an act of constituting infringement of copyright:

Thus, the act of streaming the work live to publish, distribute to the audiences without the author permission is considered the infringement of copyright.

[2] Regarding the administrative penalty, it is stipulated in Article 17 of Decree No 131/2013/NĐ-CP on sanctioning administrative violations of copyrights and related rights that:

1. A fine of between VND 15,000,000 and 30,000,000 shall be imposed for communicating a work to the public by wire or wireless means, an electronic information network or any technical means without the permission of the copyright holder in accordance with regulations.

2. Remedial measures:

Forcibly removing copies of the work which is infringed, for violation specified in Clause 1 of this Article.
