HOW WILL THE FOOTBALL BETTING PARTICIPANT BE FINED?

According to the lawyers, depending on the nature and extent of the football betting, the participants of this activity can be administratively or criminally handled. The highest penalty that participants and betting organizations can be handled is up to 7 years in prison.

According to Lawyer Nguyen Cong Tin - FDVN Law Firm, Da Nang Bar Association, the ongoing World Cup 2022 football tournament is considered the peak of football betting. Recently, when the World Cup took place a few days ago, the Ministry of Public Security broke an online betting line of nearly VND 30,000 billion.

According to lawyer Tin, there have been some cases such as debt accumulation, bridge jumping, and suicide because of football betting and gambling. Debt due to betting is one of the conditions that increase the crime of theft, robbery, fraud, etc., it brings many bad influences to the society. Therefore, the lawyer recommends that people do not participate in football betting and gambling.

How will football betting be handled? How will football betting participants be fined?

In this regard, lawyer Nguyen Cong Tin said that betting on football to get money or in kind is one of the forms of illegal gambling. Persons who commit illegal gambling acts, depending on the nature and extent, may be administratively or criminally handled.

According to the lawyer, at Point c, Clause 2, Article 28 of Decree No. 144/2021/ND-CP stipulates that people who commit illegal betting activities in sports competition, entertainment, or other activities shall be fined from 1 million to 2 million dong. The remedial measure is to be forced to return the illegal profits obtained from the commission of the violation.

In addition, those who illegally gambles in any form, wins or loses in money or kind with a value of 5 million VND or more, or less than 5 million VND but falls into one of the following cases, may be criminally prosecuted for the crime of Gambling, specifically:

Those who illegally gamble in any form to win or lose in money or kind in one of the following cases shall be subject to a fine of between VND 20 million and VND 100 million and a community sentence (non-custodial) for up to 3 years or imprisonment from 6 months to 3 years:

Money or kind of value from 5 million VND to less than 50 million VND; Money or in kind of less than 5 million dong but have been administratively sanctioned for gambling or organizing gambling; or has been convicted for the crime of gambling or the crime of organizing gambling, has not yet been cleared of criminal record but continues to commit it.

In addition, persons who participate in gambling, betting, or committing crimes in one of the following circumstances shall be sentenced to between 3 and 7 years of imprisonment: Being of a professional nature; Money or kind used for gambling valued at VND 50 million or more; Using the internet, computer networks, telecommunications networks or electronic means to commit crimes; Dangerous recidivism.

Also according to lawyer Tin, offenders can be fined from VND 10 million to VND 50 million.

Previously, the Criminal Police Department (Ministry of Public Security) coordinated with the Departments of Professional Affairs, Ho Chi Minh City Police, and Dong Nai Public Security to dismantle an online football betting line with a transaction amount of VND 30,000 billion.

The police arrested 14 people and seized many related exhibits.

The Criminal Police Department determined that this betting line was conducted through the websites "bong88" and "Agbong88", organized and operated by a group of people in the country.

This group is divided into different levels of management, operating widely in provinces and cities, dividing many accounts to hand over pages to junior dealers and gamblers.
