FDVN’s opinions:
Article 15 of the Law on Residence 2006 stipulates the place of residence of husband and wife as follows: “The place of residence of husband and wife is the place where the husband and wife regularly live together.”
While Article 20 of the Law on Residence stipulates that the wife who resides with her husband will be allowed to enter her name entered in the husband’s household registration book if the holder of the book agrees.
Thus, it can be seen that it is not compulsory for the wife to have her name entered in the husband’s household registration book after getting married. In case where the wife does not want to enter her name in her husband’s household registration book, she is not considered violating the law provisions.
However, in reality, if the couple has the same residence where is the husband's house, they should carry out the procedure of entering the name in the household registration book so that the State agency could monitor the civil status changes, thereby protecting the legitimate rights and interests of individuals and households.
