Is it possible to re-apply for a university degree?

I graduated from university in 2019, got my degree, and completed all graduation procedures. However, I found that I lost my university degree when I looked for it. Is it possible to re-issue now? I would like you to tell me the procedures to apply for the re-issuance of my degree.

Thank you for concerning FDVN’s legal services. Regarding your consulting requests, after studying the relevant legal documents, FDVN Law Firm would like to give you the following advice:

 

[1]. A university degree can only be granted once.

According to Article 2 of the Regulation on management of junior high school degrees, senior high school degrees, degrees of pedagogical intermediate, degrees of the college of education, degrees of higher education, and certificates of the national education system, issued together with the Circular No. 21/2019/TT-BGDDT dated November 29, 2019, of the Minister of Education and Training, principles of management and issuance of degrees and certificates are provided as follows:

Article 2. Principles of management and issuance of degrees and certificates

1. Degrees and certificates are uniformly managed, decentralized management of education and training departments, delegating autonomy and self-responsibility to teacher training institutions, higher education institutions as prescribed in Article 3 of this Regulation.

2. Degrees and certificates are issued once, except for the case specified in Article 18 of this Regulation.

3. All acts of fraud in the issuance and use of degrees and certificates are strictly forbidden.

4. Ensuring publicity and transparency in the issuance of degrees and certificates."

According to Clause 1, Article 18 of this Regulation, “If the issued degree or certificate is found to be incorrectly spelled due to the fault of the authority issuing the degree or certificate, that authority has the responsibility to re-issue the original degree and certificate."

Thus, the University Degree is only granted once, unless there are faults of the competent authority. Your case is not in the case of re-issuance of the university degree. Therefore, you can only apply for a copy of your university degree.

 

[2]. Procedures for issuing copies of university degrees

* Dossier to be prepared:

According to Clause 1, Article 31 of the Regulation on management of junior high school degrees, senior high school degrees, degrees of pedagogical intermediate, degrees of the college of education, degrees of higher education, and certificates of the national education system, issued together with the Circular No. 21/2019/TT-BGDDT dated November 29, 2019, of the Minister of Education and Training, you need to prepare the following documents:

- An application for a copy of the degree or certificate, which provides information about the granted degree or certificate;

- The original or a certified copy of the valid identity card or citizens’ identity card or passport for the recipient to check;

- Power of attorney (for an authorized person) or a document proving the relationship with the person who is granted the original degree or certificate (this person must meet the conditions to be entitled to request a copy of the degree as prescribed in Article 30 of this Regulation);

- In case the applicant for a copy of a diploma or certificate from the master register sends a request by post, a certified copy of the above mentioned document must be sent together with 01 (one) stamped envelope clearly stating the full name and the receiver's address to the competent authority to issue the copy of degree or certificate from the master register.

*  Order and procedures for issuing copies of university degrees:

According to Clause 2, Article 31 of this Regulation, the order, and procedures for the issuance of a copy of a university degree are as follows:

Step 1: The applicant for the issuance of the degree or certificate shall submit directly or by post 01 (one) set of application as prescribed in Clause 1 of this Article to the competent authority to issue the copy of the degree, certificate from the master register.

Step 2: On the day of receipt of the request for a copy or on the next working day, if the request is received after 03 (three) p.m, the competent authority to issue a copy of the certificate from the master register must issue copies to those who request. In case the request for a copy from the master register is sent by post, the time limit will be determined from the time the authority receiving the request for the copy receives a complete and valid dossier according to the arrival postmark.

- For cases in which copies are requested from many original registers at the same time, requiring a number of copies, the content of degrees and certificates is difficult to check and compare, the authority receiving the request for the copy can not fulfill the time limit specified, the time limit for the issuance of the copy may be extended for no more than 2 (two) working days or longer as agreed in writing with the person requesting the copy.

- In case the competent authority no longer stores the original book or there is no information in the original book about the requested content or does not issue a copy to the requester, the authority receiving the request for the copy is responsible for replying in writing to the requester and stating the reason according to the time limit stated above.
