PRIORITY POINTS WHEN TAKING PART IN THE EXAMINATION TO RECRUIT CIVIL SERVANTS

My family has revolutionary merit, my father is a martyr and now my family is living in the northern mountainous region. This year, my sister, who is the adopted child of my parents, intends to take the tax civil service exam to return to our hometown to work. I want to ask if, with my family's condition, she can be considered to add priority points for my adopted sister when taking the civil service exam? Thank you.

FDVN’s Opinions:

Regulations on recruitment, employment, and management of public employees are specifically guided in Decree No.138/2020/ND-CP of the Government, effective from December 1, 2020. Accordingly, the subjects entitled to the priority points when recruiting civil servants are as follows:

It is stipulated in Clause 1, Article 5, Decree No.138/2020/NĐ-CP, subjects and priority points in the recruitment test or recruitment examination:

1) Heroes of the Armed Forces, Heroes of Labor, War Invalids, and beneficiaries of policies such as Class B War Invalids and War invalids: 7.5 points will be added to the second round;

2) Ethnic minorities, military officers, police officers, professional servicemen, cipher workers who change majors, graduates of reserve officer training, graduates of training courses only commanders of the commune-level military commands of the grassroots military branch shall be conferred the rank of reserve officer who has registered for the rank of reserve officer, children of martyrs, children of wounded soldiers, children of sick soldiers, children of beneficiaries of policies such as war invalids, children of war invalids of class B, children of resistance activists infected with toxic chemicals, children of Heroes of the Armed Forces, children of Heroes of Labor: 5 points will be added to the results of round 2;

3) Those who have completed their military service, the obligation to join the People's Police, and volunteer youth members: 2.5 points will be added to the second round score.

Note: In case the candidate falls under many priority categories specified in Clause 1 of this Article, only the highest priority score will be added to the second round score (According to Clause 1, Article 5, Decree 138/2020/ND-CP).

According to the information provided by you, compared with the above regulations, your sister is in case number 2 above who is the child of a martyr. There is no distinction between a biological or adopted child, so her score will be plus 5 points to the result of round 2. If your sister meets additional condition number 3, the plus point will still count as 5 points. In addition, the fact that your family is living in the northern mountainous region is not considered a priority condition for adding points when taking the civil service exam.
