Thank you for trusting the legal service of FDVN Law Firm (FDVN). Regarding your case, after studying the relevant legal documents, FDVN Law Firm offers the following advice:
[1] Dossiers of civil servant recruitment
According to Circular No. 13/2010/TT-BNV, amended and supplemented by Circular No. 03/2019/TT-BNV, the dossier of recruitment of civil servants includes:
- Application for civil servant recruitment application (the form issued together with Decree 161/2018/ND-CP)
- A curriculum vitae certified by a competent authority within 30 days, up to the date of submission of the application;
- Photocopy of diplomas, certificates and academic results required by the candidate;
- A health certificate issued by a competent health authority within 30 days, up to the date of submission of the application;
- The testimonial of priority in the recruitment of civil servants (if any) certified by a competent agency.
[2] Procedures for civil servant recruitment
According to Decree No. 24/2010/ ND-CP, amended and supplemented by Decree No. 161/2018/ND-CP providing for procedures for recruiting civil servants:
Step 1: Agencies competent to recruit civil servants shall publicly announce in the mass media and on their own websites and post up at their office's recruitment criteria, conditions and quotas, the time and places for receipt of recruitment registrants' files.
Step 2: Within 30 days from the date of the notice, candidates may submit recruitment registration forms, made according to the form enclosed herewith, directly at the announced place or by post. At least 05 working days before the date of recruitment exam or recruitment by selection, the recruiting agency shall make and post the list of qualified candidates at its headquarters.
Step 3: The head of the recruiting agency shall issue a decision on the establishment of a Recruitment Council that shall take charge of organizing the recruitment. In case the number of candidates in the examination is less than 30, the head of the agency competent to recruit civil servants shall assign a department to perform the examination.
Step 4: Within 10 days from the receipt of reports on round-2 results from the Recruitment Council or personnel department, if no recruitment council is established, the recruiting agency shall openly post the results of recruitment exam or recruitment by selection, list of successful candidates at its headquarters and on its website, and also send written recruitment notices to candidates at their registered addresses.
Within 15 days from the date on which the round-2 results are made available, candidates may submit written requests for review of exam results in case the round-2 exam is made in writing as prescribed in Clause 2 Article 8 hereof. The head of the recruiting agency shall organize the review of exam results and publish results of the review within 15 days after the deadline for receiving requests for review of exam results.
The head of the recruiting agency shall report recruitment results to the official-managing agency for approval and send written recruitment notices to successful candidates at their registered addresses.
