Legal Situation: Dear Lawyer, could you please advise me on the most recent penalties for using a mobile phone while driving? Thank you for your assistance.

FDVN’s Opinion: Thanks for trusting and sending a question to FDVN Law Firm (“FDVN”). FDVN would like to provide the following information in response after studying the legal regulations: 

1. For automobile drivers

Pursuant to Point h Clause 5, Point b Clause 10, and Points b and d Clause 16 Article 6 of Decree No. 168/2024/NĐ-CP, the penalties applicable to automobiles are as follows:

Using a mobile phone or other electronic devices while holding them by hand when operating a vehicle on the road may result in a fine from VND 4,000,000 to 6,000,000 and a deduction of 4 points from the driver’s licence.

Using a mobile phone or other electronic devices while holding them by hand when operating a vehicle on the road that leads to a traffic accident may result in a fine from VND 20,000,000 to 22,000,000 and a deduction of 10 points from the driver’s licence.

2. For motorcycle drivers

According to Point đ Clause 4, Point b Clause 10, and Points b and d Clause 13 Article 7 of Decree No. 168/2024/NĐ-CP, the penalties for motorcycle operators are as follows:

Using an umbrella, an audio device (except hearing aids), or using a mobile phone or other electronic devices while holding them by hand may result in a fine from VND 800,000 to 1,000,000 and a deduction of 4 points from the driver’s licence.

Using an umbrella, an audio device (except hearing aids), or using a mobile phone or other electronic devices while holding them by hand that causes a traffic accident may result in a fine from VND 10,000,000 to 14,000,000 and a deduction of 10 points from the driver’s licence.

3. For bicycle, electric bicycle, and other non-motorised vehicle users

Under Point h Clause 1 Article 9 of Decree No. 168/2024/NĐ-CP:

Riding a bicycle or electric bicycle while using an umbrella, using a mobile phone or other electronic devices by hand, or carrying a passenger who is using an umbrella may result in a fine from VND 100,000 to 200,000.
