What is a personal identification number? Order and procedures for issuance of personal identification numbers?

My name is Trinh Duy A, I am living and working in Hanoi. As my wife is about to give birth next month, I heard from my colleagues that an identification number will be issued when I register for a birth certificate. However, I don't know about the identification number and the order to be granted this one. I hope FDVN Law Firm can advise me. Thank you!

Thank you for concerning FDVN legal services. Basing on your consulting requirements, after studying the legal documents, FDVN Law Firm offers the following advice:

[1] What is a personal identification number?

Pursuant to Article 13 of Decree No. 137/2015/ND-CP providing for the structure of personal identification numbers: “The personal identification number is a 12-digit natural number, structured with 6 numbers, including the birth century code, gender code, the citizen's year of birth, the code of the province or centrally-run city or country code where citizens are registered and 6 numbers are random numbers.”

Pursuant to Article 12 of the Law on Citizen Identification 2014:

“A personal identification number shall be established from the national population database and used for the connection, update, sharing and exploitation of citizen’s information in the national population Database and specialized databases. Personal identification numbers shall be uniformly managed nationwide by the Ministry of Public Security; each Vietnamese citizen shall be granted with one number which is not identical to another’s number.”

[2] Order and procedures for the grant of personal identification numbers to citizens with birth registration

Pursuant to Article 14 of Decree No. 137/2015/ND-CP, the order and procedures for the grant of personal identification numbers to citizens with birth registration are as follows:

 If the electronic civil status Database has been connected to the national Database on population, when receiving all papers for birth registration, the civil status registration, management and the electronic civil status database management agency is responsible for immediately transferring information of the person registered for birth to the national Database on population; in which the following information must be collected to grant personal identification numbers:

  • Full name;

  • Date of birth;

  • Gender;

  • Place of birth registration;

  • Native place;

  • Ethnicity;

  • Nationality;

  • Full name and nationality of parents or legal representative; except for cases where the parent or legal representative can not be identified.

The Head of the national population Database management agencies of the Ministry of Public Security shall take responsibility for checking information and documents according to the provisions of paragraph b, Clause 3, Article 13 of the Law on Citizen Identification 2014, issue and immediately transfer the personal identification numbers for the civil status management and registration agencies.

In case the national Database on population agency has not yet operated or the electronic civil status Database has not been connected to the national Database on population, when receiving the birth registration dossier of citizens, civil status management and registration agencies shall immediately transfer the information specified in Clause 1 of this Article to the Internet-based national database management agency granted the access account.

The national population Database management agencies are responsible for granting access accounts to the civil status management and registration agencies and immediately transferring the personal identification number of the citizens to the civil status management and registration agencies when receiving birth registration information through the Internet. Civil status registration and management agencies are responsible for keeping access accounts confidential in accordance with the law on the protection of state secrets.
