Client’s request: What you need to do to open a veterinary drug store?

I like animals so much. I often adopt abandoned animals. I am quite good at caring for and treating dogs and cats. I graduated from Nong Lam University and have not had any job. So, my friend suggested that I open a veterinary drug store. I would like to ask how to open a veterinary drug store?

 [1] Requirements for trading in veterinary drugs

According to Article 92 of Law on veterinary medicine 2015:

Article 92. Requirements for trading in veterinary drugs

Organizations/individuals trading in veterinary drugs shall satisfy the following conditions:

1. Having the Certificate of Business registration or the Certificate of Enterprise registration;

2. Having appropriate location and facilities;

3. People who manage or directly perform the sale of veterinary drugs shall have veterinary practice certificates;

4. Having the Certificate of eligibility for trading in veterinary drugs.”

According to Article 17 of Decree No. 35/2016/ND-CP on guidelines for the Law of veterinary medicine regulation about requirements for trading in veterinary drugs:

Article 17. Requirements for trading in veterinary drugs

Each veterinary drug trader must comply with Article 92 of the Law on veterinary medicine and satisfy the following requirements

2. Having enough counters, cabinets, shelves to store, store and display products must be sure, easy to clean, and avoid the adverse effects of light, temperature, humidity, mold, rodents vinegar, and insect pests.

3. Having the equipment to ensure the storage conditions inscribed on the product's labels; have thermometer, hygrometer to monitor product storage conditions. For establishments trading in vaccines and/or biological preparations, there must be refrigerators, coolers or cold storages; have a thermometer to check storage conditions; have backup generators, supplies, and means of transportation for distribution of vaccines, ensuring the storage conditions inscribed on the product labels.”

So, to trade in veterinary drugs, you must meet the conditions in Law on veterinary medicine 2015 and Decree No. 35/2016/ND-CP, amended by Decree No. 123/2018/ND-CP.

[2] The procedure for registration of veterinary drug business

Firstly, about the registration files:

- The Certificate of Enterprise registration or the Certificate of Business registration;

- The veterinary practice certificate;

- An application form for issuance, extension or re-issuance of the certificate of eligibility to trade/import veterinary drug using the form provided in Annex XX or XXXI enclosed with Circular No. 13/2016/TT-BNNPTNT;

- A detailed description of facilities and technology for the manufacture of veterinary drug using the form specified in Annex XXII enclosed with Circular No. 13/2016/TT-BNNPTNT;

- An inspection record of the conditions of trade/import of veterinary drugs using the form in Annex XXIV enclosed with this Circular and a certificate of eligibility to trade/import veterinary drugs using the form in Annex XXVI or XXVII enclosed with Circular 13/2016/TT-BNNPTNT.

Secondly, the procedure of registering veterinary drug business:

Step 1: Preparing the business registration files.

Step 2: Submitting the registration files to Department of Animal Health;

Step 3: The Department of Animal Health examines the documents.

Within 10 days from the day on which the satisfactory application is received, the Department of Animal Health shall conduct an on-site inspection. If the establishment satisfies the requirements, within 03 working days from the day on which the inspection finishes, the Department of Animal Health shall grant the Certificate of eligibility for importing veterinary drugs.

If the application is rejected, a written response containing the explanation shall be made.

Step 4: Receiving the result at the Department of Animal Health
