CONSULTATION ON THE DOCUMENTS AND PROCEDURE FOR ENTERPRISES TO PAY SOCIAL INSURANCE FOR EMPLOYEES

Legal inquiry: Dear Lawyer, I would like to ask what my company needs to do to register social insurance for new employees?

Thank you for sending your question to FDVN Law Firm. Regarding your inquiry, after researching the relevant legal regulations, FDVN would like to provide the following information:

Documents required for enterprises to pay Social Insurance (SI) for employees:

According to Article 23 of Decision 595/QĐ-BHXH in 2019 and the guidelines from Decision 222/QĐ-BHXH, the documents required for registering social insurance for new employees include the following:

1. For employees

- Social Insurance and Health Insurance Participation Application Form (Form TK1 – TS).

- In case the employee is entitled to higher health insurance benefits, any supporting documents should be added (if available), according to Appendix 03.

2. For employees working abroad under contracts as specified in Subsections a, c, and d of Point 1.7, Clause 1, Article 4 

Social Insurance and Health Insurance Participation Application Form (Form TK1 – TS).

- A temporary employment contract in a foreign country or an employment contract that has been renewed, together with a renewal contract, or a new employment contract signed in the country where the employee is working, as agreed in the original contract.

3. For enterprise 

- Social Insurance and Health Insurance Participation and Adjustment Form (Form TK3 – TS).

- Report on Employment Utilization and List of Participants in Social Insurance, Health Insurance, and Unemployment Insurance (Form D02 – LT).

- Information Table (Form D01 – TS).

Both the enterprise and the employees only need to prepare one complete set of documents for submission to the Social Insurance Agency.

2. Procedures for enterprises to pay Social Insurance for new employees

Based on Chapter IV of Decision 595/QĐ-BHXH and the guidelines provided in Decision 222/QĐ-BHXH, the procedures for registering social insurance contributions are as follows:

Step 1: Employee and Employer collaborate to complete the application

Step 2: Employer submits the application to the social insurance agency

Methods of submitting the application

+ Submit application via postal service

+ Submit application in person at the one-stop department of the social insurance agency or at the administrative service center

+ Submit application online via vietnam social insurance electronic information system or i-van organization

Step 3: Employer pays social insurance, unemployment insurance, and health insurance contributions to the social insurance agency

Step 4: Social Insurance Agency issues social insurance books and health insurance cards

Timeframe for processing: Maximum of 5 days – no fees for social insurance registration

The issuance of social insurance and health insurance books is determined by the enterprise's registration.

3. Timeframe for initial registration and issuance of social insurance books

Within 30 days from the date of signing the Labor Contract, Working Agreement or recruitment, the enterprise shall submit a registration application for social insurance and obtain a social insurance book from the Social Insurance Agency (pursuant to point a, Clause 1, Article 99 of the 2014 Social Insurance Law).
