Is it compulsory to pay salary and social insurance during the maternity period?

It's been 12 months since I have worked for P.T Company in Da Nang City. I will leave for the maternity period for 6 months. I would like to know if I am paid the salary and social insurance in this period?

Thank you for concerning and trusting in FDVN’s legal services. We have studied the law provisions to provide you with our advice. Please kindly see the answer below:

 [1]. Is an employee paid the salary in the maternity period?

According to Article 157 of the Labor Code 2012 on maternity leave:

“1. A female employee is entitled to 6 months of prenatal and postnatal leave.

In case a female employee gives birth to twin or more babies, counting from the second child upward, for each child the mother is entitled to 1 more month off.

Prenatal leave must not exceed 2 months.

2. During the maternity leave, a female employee is entitled to maternity policies provided by the law on social insurance.

3. After the maternity leave period stipulated in Clause 1 of this Article, if a female employee wishes, she may take additional leave without pay as agreed upon with the employer.

4. Before the expiration of her maternity leave stipulated in Clause 1 of this Article, a female employee may return to work if she so wishes and the employer so agrees provided that she has a certificate from a competent health establishment that early resumption of work will not adversely affect her health and she has taken at least 4 months of maternity leave.

In this case, the female employee continues to receive the maternity allowance as provided by the law on social insurance, in addition to the wage paid by the employer for her working days.”

Besides, it is stipulated in Clause 2 Article 186  of this Code:

“2. When an employee is absent from work and covered by social insurance, the employer is not required to pay a wage to the employee.”

Referring to the above provisions, during the maternity leave, you have been entitled to the maternity regime in accordance with the law on social insurance, accordingly, T.P Company will not have to pay you the salary in 06 ( six) months you leave for maternity period.

 [2]. Is it compulsory for the employer to pay social insurance for an employee in her maternity period?

According to Clause 2, Article 39 of the Law on Social Insurance 2014: “2. The maternity leave period of 14 working days or more in a month shall be regarded as a period of social insurance premium payment. During this period, employees and employers are not required to pay social insurance premiums.

Therefore, if an employee leaves 14 days or more in a month, it is calculated as the time of social insurance payment, the employee and the employer are not required to pay social insurance. If the employee is absent for less than 14 days in a month, the employee and the employer must pay social insurance in that month.
