I am Thuy, working at A Company in March 2018 and in April 2018 I started to pay social insurance. In 09/2018 I had a traffic accident so I had to be treated at the hospital for 3 months, at this time of treatment I was entitled to a sickness allowance. In March 2019, I want to pick B up to my adoption (3 months old). So will I be entitled to maternity benefits when receiving B adoption?

Pursuant to Point d, Clause 1 and Clause 2, Article 31 of the Law on Social Insurance 2014 stipulating Conditions for enjoying the maternity regime:
“1. Employees shall be covered by the maternity regime in one of the following cases:
....
d/ Employees adopting under-6-month children;
2. To enjoy the maternity regime, employees defined at Points b, c and d, Clause 1 of this Article must have paid social insurance premiums for at least full 6 months within 12 months before childbirth or child adoption.”
Pursuant to Clause 4 Article 6 of Circular 59/2015 / TT-BLDTBXH stipulating the level of sickness benefits:
“The employees take sick leave from 14 days or more in a month, the employees and the employers do not have to pay the social insurance of such month. This period of time shall not be calculated for entitlement to social insurance.”
Therefore, in order to be entitled to maternity regime, you must pay social insurance for 06 months or more within 12 months before you adopted. But you have taken sick leave for 3 months from 09/2018 to 12/2018, during the sick leave period, it is not counted as the time of social insurance payment. Therefore, by the time she adopted the child, you still were not eligible for maternity benefits.
